These SMS/MMS Terms and Conditions (the “Terms”) govern the text messaging program offered by Mt. Washington Tracker, a sole proprietorship owned and operated by Dylan Wood (“Mt. Washington Tracker,” “we,” “us,” or “our”). By opting in to the program, you agree to these Terms and to the Privacy Policy below.

1. Program description

Messages may include SMS or MMS weather conditions, forecasts, weather-related informational alerts, account or preference notices, and service updates related to Mt. Washington Tracker. Messages are informational only and are not official weather warnings, emergency alerts, or mountain-safety guidance. Always consult official sources, including the National Weather Service and local authorities, before making travel, hiking, or safety decisions.

The messaging program is not used for third-party or affiliate marketing or for third-party lead generation.

2. Consent and eligibility

You may opt in only through a method presented by Mt. Washington Tracker, such as an online form or a designated text-message keyword. By opting in, you provide express consent to receive recurring automated SMS and MMS messages from Mt. Washington Tracker at the mobile number you provide. Consent is not a condition of any purchase. You must be at least 18 years old, or the age of majority where you live, and you must be the account holder or have the account holder’s permission to enroll the number.

3. Message frequency and charges

Message frequency varies based on weather conditions, your selections, and service activity, and may increase during rapidly changing weather conditions. Message and data rates may apply according to your mobile plan. Mt. Washington Tracker does not charge a separate fee for the messaging program.

4. Opting out

You may cancel at any time by replying STOP to any message. You may also use other supported opt-out keywords, including CANCEL, END, QUIT, REVOKE, OPT OUT, or UNSUBSCRIBE. After you opt out, you may receive one final confirmation message. No further program messages will be sent unless you opt in again.

6. Delivery and carrier terms

Mobile carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier, device, network availability, and other factors outside our control. The program may not be available on all devices or through all carriers. You are responsible for keeping your mobile number current and for opting out before transferring or discontinuing a number enrolled in the program.

7. Changes or termination

We may modify, suspend, or discontinue the messaging program or these Terms. Material changes will be reflected by updating the date at the top of this page. Your continued participation after an update means you accept the revised Terms. If you do not agree, reply STOP to leave the program.
